Limitation of Liability

This page explains where Fundorra's legal responsibility to you ends. It supplements our Terms of Use, which govern your use of the platform as a whole.

1. No guarantee of results

Fundorra is provided on the basis of the technology and conditions currently available. While we do our best to keep it accurate and online, we cannot guarantee continuous or fault-free operation, or any particular outcome from using it. Where the law allows, we accept no responsibility for losses arising in the circumstances listed below.

2. Events we cannot control

  • Problems with telecom networks, internet access, electricity or external hosting services.
  • Exchanges, liquidity sources, price providers or blockchains going offline, pausing, lagging or publishing bad data.
  • Errors, hold-ups or reversed payments in banking and payment networks.
  • Official or regulatory measures, judicial orders, sanctions, armed conflict, civil disturbance, disease outbreaks or natural catastrophes.
  • Cyberattacks on the services we rely on, for example denial-of-service attacks or breaches at our suppliers.

3. Things that are your responsibility

Fundorra is not responsible for losses that happen because of:

  • Someone else learning or obtaining your sign-in details, security password or two-factor device.
  • Any instruction made through your account — for example trades you open or withdrawal addresses you enter.
  • Coins sent to a mistyped destination or over a network Fundorra does not handle.
  • Viruses, phishing attacks or programs you did not authorise running on your computer or phone.
  • Ignoring a margin call or failing to keep track of an open position.

After a withdrawal has been broadcast, its destination address can't be changed, so check the address and network carefully before you confirm.

4. Downtime for maintenance

Parts or all of the service may be paused for maintenance or upgrades, or to fix a security or integrity problem. We give advance notice of planned downtime wherever we can. Losses resulting from a good-faith pause — including trades you could not open or close during it — are not our responsibility.

5. External content

Some data, research or links on the platform come from other companies. We don't endorse or guarantee that content, and we aren't responsible for decisions you make because of it. Any relationship you have with a third party is between you and them alone.

6. Losses from trading

We do not control the markets. If you lose money because prices move, because of your own trading choices, or because a strategy on the platform performs poorly, that loss is yours. This page is not investment advice, and we do not guarantee any return.

7. Pricing and execution errors

When a trade is executed at a clearly incorrect price caused by faulty data rather than genuine market activity, we may reverse the trade and refund the stake. Where a Fundorra mistake directly costs you money, the remedy is to fix the entry concerned, and that fix marks the limit of what we owe.

8. Losses we exclude

Within the limits of the law, Fundorra is not liable for any indirect, incidental, special or consequential loss, or for lost profits, revenue, data or opportunities, regardless of how they arise.

This does not affect any liability that the law does not permit us to exclude, such as liability for fraud or fraudulent misrepresentation.

9. When you are liable to us

If we suffer a loss because you breached the Terms of Use, misused the platform or violated someone else's rights, you are responsible for that loss.

10. Disputing an entry

Spot something wrong in your account? Contact us on live chat straight away and give us the reference number from your transaction history. We can check a recent issue against complete records, but that is often impossible for issues raised long after the event.
